Terms and Conditions
These Terms & Conditions explain the terms that apply when you use the EverKin Stories website. They are separate from the Client Agreement that applies when you book an EverKin Stories service.
1. About EverKin Stories
EverKin Stories is a life-story film service owned and operated by Fiona Agyemang (“EverKin Stories”, “EverKin”, “we”, “us” or “our”). Our website provides information about our Life Story Films, packages, process and how to contact us.
2. Using this website
You may use this website for lawful purposes and to find out about EverKin Stories and our services. You must not use the website in a way that could damage, disable, overburden or interfere with the website or with other people’s use of it. You must not attempt to gain unauthorised access to the website, its systems or information.
3. Information on the website
We aim to keep the information on the website accurate and up to date. However, website information is provided for general information and may change from time to time. Descriptions of our services, packages, prices, timings and availability are subject to change. The terms that apply to a particular booking are those confirmed with you in writing and set out in the applicable Client Agreement. A website price or description does not by itself create a contract for a particular service.
4. Enquiries and bookings
You are welcome to contact us through the website to ask questions or make an enquiry. An enquiry does not constitute a booking. A booking is only confirmed when EverKin Stories has agreed the service with you, the relevant booking arrangements have been accepted, and the required booking deposit has been received and confirmed. Our Client Agreement and the terms agreed for your selected package will apply to confirmed bookings.
5. Prices and payment
Prices shown on the website are the prices published at the time, unless otherwise stated. Where you decide to book, the price and payment arrangements applicable to your project will be confirmed before the booking is finalised. Our current EverKin packages use a 50% booking deposit to secure the agreed filming date, with the remaining balance payable before final delivery, unless different arrangements have been agreed with you in writing.
6. Cancellation and consumer rights
Cancellation, rescheduling and any applicable cooling-off rights for a booked service are dealt with in the Client Agreement and are subject to applicable UK consumer law. Nothing in these Website Terms & Conditions is intended to remove or restrict a legal right that cannot lawfully be excluded or restricted.
7. Intellectual property
Unless otherwise stated, the content of this website belongs to EverKin Stories or is used with permission. This includes our written content, branding, logo, photographs, graphics, design and other original material. You may view and use the website for your own personal, non-commercial purposes. You must not copy, reproduce, republish, modify, distribute or commercially exploit our website content without our written permission. The EverKin Stories name, logo and branding may not be used without our permission.
8. Client stories, photographs and testimonials
Any photographs, stories, testimonials or other material provided by a client remain subject to the permissions and agreements relating to that material. We will only use a client's story, photographs, finished film, testimonial or other personal material for public promotion where the appropriate permission has been given. The separate Client Agreement and any specific consent or release form will set out the arrangements for a particular project.
9. Links to other websites
Our website may contain links to websites or services operated by other organisations. These links are provided for convenience or information. We do not control those websites and are not responsible for their content, availability, security or privacy practices. You should check the terms and privacy information of any third-party website you visit.
10. Website availability and security
We aim to keep the website available and functioning properly, but we cannot guarantee that it will always be available, uninterrupted or free from errors. We may update, suspend, change or remove parts of the website from time to time. We take reasonable steps to operate the website securely, but no online service can be guaranteed to be completely secure.
11. Liability
We will not be responsible for losses that arise solely from your use of the website where those losses could not reasonably have been expected from your use of the website. Nothing in these Terms & Conditions excludes or limits liability where doing so would be unlawful, including liability for matters that cannot legally be excluded or limited. These Website Terms & Conditions do not reduce any statutory rights you may have as a consumer.
12. Privacy
Your privacy matters to EverKin Stories. Information about how we collect, use and protect personal information is explained in our Privacy Policy. If you contact us through the website, we may use the information you provide to respond to your enquiry and, where appropriate, to arrange or administer an EverKin service.
13. Changes to these terms
We may update these Website Terms & Conditions from time to time, for example if the website, our services or applicable requirements change. The version published on the website will be the current version for use of the website. Changes will not retrospectively alter the terms of a confirmed client booking.
14. Governing law
These Website Terms & Conditions are governed by the law of England and Wales. If you are a consumer, you may also have rights under the laws that apply to you which cannot be excluded by these terms.
